At the same time, it has created significant challenges for copyright owners seeking to protect their works from unauthorised copying, distribution, streaming, and downloading.<\/p>\n\n\n\n<p>Online piracy can spread copyrighted content within minutes and can be replicated across multiple websites, mirror domains, and redirecting platforms. As a result, traditional website-specific enforcement mechanisms are often insufficient to effectively address digital infringement.<\/p>\n\n\n\n<p>Indian copyright law has consequently evolved to address these challenges through a combination of <strong>statutory remedies, intermediary obligations, technological protection measures, and judicially developed dynamic injunctions<\/strong>.<\/p>\n\n\n\n<p>This article examines the key legal mechanisms available for combating digital copyright infringement and online piracy in India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Intermediary Liability and Safe Harbour<\/h2>\n\n\n\n<p>The Information Technology Act, 2000 provides intermediaries with protection from liability for third-party content, subject to prescribed conditions. This is commonly referred to as the <strong>safe harbour regime<\/strong>.<\/p>\n\n\n\n<p>An intermediary may generally claim protection where it acts as a passive platform and satisfies the statutory requirements, including requirements relating to its role in transmitting or hosting third-party information and compliance with applicable due diligence obligations.<\/p>\n\n\n\n<p>However, intermediary safe harbour does not provide an absolute defence against copyright enforcement. The Copyright Act, 1957 continues to provide copyright owners with independent remedies against infringement.<\/p>\n\n\n\n<p>The legal framework therefore seeks to balance two competing interests: protecting legitimate online intermediaries from automatic liability for user-generated content while ensuring that copyright owners have effective remedies against unlawful use of their works.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Notice-and-Takedown Mechanism<\/h3>\n\n\n\n<p>The Copyright Act also recognises circumstances in which an intermediary may be required to remove or disable access to infringing material following a complaint.<\/p>\n\n\n\n<p>Under the relevant statutory framework, where an intermediary receives a complaint concerning allegedly infringing material, access to the material may be disabled for the prescribed period unless the person responsible for the material obtains an appropriate court order.<\/p>\n\n\n\n<p>This mechanism is particularly important because it provides copyright owners with a relatively rapid method of addressing online infringement without having to immediately pursue every infringing instance through a separate and lengthy proceeding.<\/p>\n\n\n\n<p>However, notice-and-takedown mechanisms alone can be inadequate where infringing material is repeatedly uploaded or transferred to new domains.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Dynamic Injunctions Against Piracy Websites<\/h2>\n\n\n\n<p>One of the most significant developments in Indian copyright jurisprudence has been the emergence of <strong>dynamic injunctions<\/strong>.<\/p>\n\n\n\n<p>In <strong>UTV Software Communication Ltd. v. 1337X<\/strong>, the Delhi High Court recognised that conventional website-blocking orders could become ineffective in the digital environment. Once one infringing domain is blocked, the same operators may quickly create mirror, redirect, or alternative websites offering substantially the same infringing content.<\/p>\n\n\n\n<p>The Court therefore recognised the concept of a <strong>\u201crogue website\u201d<\/strong>\u2014a website whose primary purpose or predominant activity is facilitating copyright infringement, particularly where the infringement is substantial and the identity of the operators is difficult to establish.<\/p>\n\n\n\n<p>Dynamic injunctions enable rights holders to seek appropriate blocking measures not merely against an identified infringing website, but also against subsequently identified mirror or redirect websites that reproduce the same infringing activity.<\/p>\n\n\n\n<p>This approach is particularly valuable because it reduces the need for copyright owners to commence entirely new proceedings every time an infringing website changes its domain name.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Dynamic-Plus Injunctions<\/h2>\n\n\n\n<p>The judicial approach has subsequently developed further through the concept of <strong>dynamic-plus injunctions<\/strong>.<\/p>\n\n\n\n<p>A dynamic-plus injunction can provide protection against websites that may emerge in the future as extensions, mirrors, or successors of an already identified rogue website.<\/p>\n\n\n\n<p>This remedy becomes especially significant in situations where infringement causes substantial and irreversible commercial harm within a very short period.<\/p>\n\n\n\n<p>For example, in cases involving <strong>live sporting events, films, television programmes, or other time-sensitive content<\/strong>, unauthorised streaming during the relevant event can cause immediate loss to copyright owners and legitimate broadcasters. A remedy obtained only after the event may have little practical value.<\/p>\n\n\n\n<p>Dynamic-plus injunctions therefore seek to provide a more preventive form of protection by enabling rights holders to act against future infringing domains within the scope of the judicial order.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Technological Protection Measures<\/h2>\n\n\n\n<p>Copyright protection in the digital environment is not limited to court orders and intermediary enforcement. Indian copyright law also recognises the importance of <strong>technological protection measures (TPMs)<\/strong>.<\/p>\n\n\n\n<p>The Copyright Act, 1957 contains specific provisions dealing with technological measures and rights management information.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 65A \u2013 Circumvention of Technological Measures<\/h3>\n\n\n\n<p>Section 65A addresses the circumvention of effective technological measures used by copyright owners to protect their works.<\/p>\n\n\n\n<p>The provision seeks to discourage deliberate attempts to bypass technological safeguards implemented to protect copyrighted digital content, subject to the statutory requirements and exceptions.<\/p>\n\n\n\n<p>This is particularly relevant in the digital environment, where copyright owners may use encryption, access controls, digital locks, or other technological mechanisms to restrict unauthorised access or copying.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 65B \u2013 Rights Management Information<\/h3>\n\n\n\n<p>Section 65B deals with the removal or alteration of <strong>rights management information<\/strong>.<\/p>\n\n\n\n<p>Rights management information can help identify the copyright owner, author, terms of use, or other information associated with a digital work. Unauthorised removal or alteration of such information can make it more difficult to identify ownership and enforce copyright.<\/p>\n\n\n\n<p>Together, Sections 65A and 65B strengthen the legal framework for protecting copyrighted works against technological circumvention and manipulation of digital rights information.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Challenges in Combating Online Piracy<\/h2>\n\n\n\n<p>Despite these legal developments, online piracy continues to present significant enforcement challenges.<\/p>\n\n\n\n<p>Piracy operators may operate anonymously, use foreign jurisdictions, frequently change domain names, employ mirror websites, or distribute content through multiple platforms simultaneously. Consequently, identifying the actual infringer and obtaining effective relief can be difficult.<\/p>\n\n\n\n<p>The speed at which digital content can be copied and redistributed also creates a significant enforcement gap. At the same time, <strong>technological protection measures and rights management provisions<\/strong> provide additional tools for safeguarding digital content.<\/p>\n\n\n\n<p>India&#8217;s approach therefore combines statutory remedies with evolving judicial mechanisms to address the realities of online copyright infringement.
